Chapter 50. OFFENSES AND MISCELLANEOUS PROVISIONS |
Article I. IN GENERAL |
§ 50-3. Used tire disposal fee.
(a)
Definitions.
(1)
Passenger tire means all whole unshredded tires with a diameter of 20 inches or less.
(2)
Unmanifested tire means any tire upon which the predisposal fee mandated by T.C.A. § 67-4-1603 has not been paid.
(b)
The county executive or his duly appointed agents shall collect upon all unmanifested tires presented to or collected by the county for disposal the following fees:
(1)
On each passenger tire, fifty cents per tire.
(2)
For all other tires, one dollar per tire.
(c)
This fee shall be imposed only upon unmanifested tires. It shall at all times be the responsibility of the person presenting such tires to the county for collection and disposal to show that the predisposal fee mandated by T.C.A. § 67-4-1603 has been paid upon the tires presented for disposal.
(d)
In the event that the state legislature amends T.C.A. § 67-4-1603 or any other provision of the Tennessee Code so as to provide a predisposal fee on tires not currently assessed a predisposal fee, enforcement of this section shall be adjusted so as not to impose a county fee on any tire assessed a predisposal fee by the State of Tennessee.
