§ 4-2. Beer law and policy enforcement.

  • (a)

    The county commission shall administer the beer laws in the county.

    (b)

    The county commission is empowered to grant, deny, suspend, or revoke beer permits, issue temporary or special events permits, and to impose civil penalties.

    (c)

    The county commission has exclusive power to issue, suspend, and revoke beer permits within the unincorporated areas of the county, subject only to state law, the County Charter, county ordinance, and review by a court of competent jurisdiction.

    (d)

    The county commission shall adopt bylaws governing county commission business.

    (e)

    The county law director or his representative shall preside over the hearing and shall be responsible for ruling on all procedural and evidentiary questions, provided, however that rulings on procedural questions may be overruled by a majority of the members of the county commission. The law director or his designee may allow such evidence as is necessary to allow the prosecution and defense to present their cases, but shall disallow evidence or testimony that is plainly irrelevant or cumulative.
