§ 48-32. Permits.

  • (a)

    Permit required. It shall be unlawful for any person to operate a mobile/manufactured home park within the county without a valid permit issued by the health officer in the name of such person for the specific mobile/manufactured home park.

    (b)

    Issuance of permit.

    (1)

    Any person desiring to operate a mobile/manufactured home park shall make written application for a permit on forms provided by the health department.

    (2)

    Complete plans and specifications shall be submitted to the health officer or representative prior to any construction and should include the following:

    a.

    The area and dimensions of the mobile/manufactured home park.

    b.

    The number, dimensions and location of all mobile/manufactured home sites.

    c.

    The location of all roads, streets and parking areas in the park.

    d.

    The location and identification of service buildings and other proposed existing structures.

    e.

    The location of all public water and sewer lines, and if individual sewage systems are to be utilized, locations and plans shall be submitted.

    f.

    Evidence of compliance with all county building and zoning regulations.

    (3)

    Prior to final approval of an application for a permit, the health officer or authorized representative shall inspect the mobile/manufactured home park to determine compliance with the requirements of this article.

    (4)

    Permits are not transferable.

    (5)

    Changes in the size of a park, such as the number of mobile/manufactured home sites, or changes in the sewage treatment method or water supply system shall not be made without prior approval of the health officer. Upon approval, a new permit shall be required. Plans and specifications may also be required.

    (c)

    Permit fee. Before a permit is issued, an annual permit fee shall be paid to the county health department. The fee shall be based on the number of mobile/manufactured home sites available in the park. The fee shall be $2.00 for each site, and the permit shall designate the number of sites approved; provided that the minimum fee shall be $25.00 and the maximum fee shall be $200.00. This fee shall be due January 1 of each calendar year and will be for a 12-month period. Payment must be received by January 31 of each year.

    (d)

    Permit revocation. The permit to operate a mobile/manufactured home park may be revoked by the health officer for failure to correct serious or repeated violations of this article. Reasonable notice shall be given to correct any violation noted and prior to permit revocation the permittee shall be given an opportunity for a hearing. When a permit has been revoked, the holder of the revoked permit may make a written application for a new permit.
