§ 42-1. Unauthorized wearing of uniform or insignia resembling local law enforcement agencies' uniforms or insignia prohibited.

  • (a)

    No person not a member of a law enforcement agency shall establish as a uniform for employees nor shall any individual wear any uniform designed so that it appears to be an official uniform of the county sheriff's department or the Knoxville Police Department. A uniform has such appearance when a person of normal intelligence would be likely to confuse and assume the wearer of such uniform as a member of the county sheriff's department or the Knoxville Police Department.

    (b)

    It shall be unlawful for any person to affix a patch, badge or any other insignia to any uniform or article of clothing when by attaching such insignia a person of normal intelligence would assume the wearer of such insignia was a member of the county sheriff's department or the Knoxville Police Department or any other local law enforcement agency.

    (c)

    Any person found in violation of this section shall be subject to a maximum penalty and forfeiture of not less than $50.00 nor more than $500.00.
