§ 38-226. Retroactive construction.

  • (a)

    Water supply. All water utilized by the facility shall be from a potable source approved by the department and all water fixtures shall be provided with approved backflow/backsiphonage devices.

    (b)

    Sewage disposal. Sewage and wastewater shall be disposed of by methods approved by the Department.

    (c)

    Facilities.

    (1)

    The drain system shall have a six-inch air gap between the drain discharge and the sanitary sewer. There shall be no connection between the deck drains and the re-circulation or spray systems. Deck drain covers shall have openings not exceeding one-half-inch in width. Drain covers shall be firmly affixed and shall not be able to be removed without the use of tools.

    (2)

    Electrical wiring not in conduit shall not pass within twenty feet horizontally of the amusement splash pad, deck, or feature devices. All electrical equipment shall meet all applicable state and local codes. All electrical outlets within 50 feet of the spray pad/deck shall be ground fault circuit interrupter (GFCI) protected.

    (3)

    All re-circulation equipment and facilities, chemical feeder areas, chemical storage, and related areas shall be secured from unauthorized access.

    (4)

    Feature devices shall be constructed of durable, cleanable, inert, non-splintering materials and shall present no sharp or pointed aspects to patrons. Feature devices shall be designed so that limb entrapment does not occur. Spray devices protruding above pad level shall be easily visible and present no tripping hazard. Device nozzle openings in the pad or nozzle openings on devices that are accessible to patrons shall not exceed one-half-inch. Fogging or misting devices that produce finely atomized water droplets shall be directly connected to a potable water source. There shall be no submerged inlets or cross-connections for these fogging or misting devices.

    (5)

    Spray pads with steps, risers, platforms or other changes in elevation shall be conspicuously identified in contrasting markings or coloration.

    (6)

    Spray pad drain covers shall be firmly affixed and shall not be able to be removed without the use of tools.

    (d)

    Re-circulation system. The re-circulation system shall be designed to operate 24 hours per day regardless of whether the feature system is operating. The re-circulation system shall be designed so that the feature pump system cannot operate independently if the re-circulation pump system fails.

    (1)

    Filter backwash wastewater shall discharge to a sanitary sewer or other approved disposal system through a six-inch or greater air gap.

    (2)

    An automatic chlorinator shall be provided for the treatment of the re-circulation system water. The device shall meet NSF standards. The device shall be installed according to the manufacturer's directions and shall be capable of providing adequate disinfection based on the manufacturer's design criteria and these regulations. Elemental chlorine (gas), cyanurate chlorine, and polyhexamethyl biquanide systems are prohibited.

    (3)

    If provided, the heater shall have an automatic thermostat that will not allow the water to go above 104° Fahrenheit. A heater bypass shall be provided with valves and piping sized the same as the return face piping between the filter and collector tank.
