Article VII. INTERACTIVE WATER AMUSEMENTS |
§ 38-224. Inspections.
Inspections shall be performed monthly while the interactive water amusement facility is operating. Inspections shall be recorded on forms provided by the department and upon completion of the inspection, a copy of the inspection report stating violations found and compliance dates shall be furnished to the permit holder or the authorized representative. The inspection report copy shall be available to the public on request. The inspection shall be of the pass/fail, non-scoring type. The inspection form shall be divided into two sections: Critical, physical and operational parameters and non-critical physical and operational parameters. A failing inspection shall be one that has critical items noted. An interactive water amusement shall have ten calendar days in which to correct critical items noted except for those critical items that are imminent health hazards. The interactive water amusement shall close immediately and not reopen until the imminent health hazard is corrected and written approval given by the department. After ten days a re-inspection shall be conducted to determine if critical items have been corrected. If critical violations remain after the ten-day re-inspection, a 48-hour re-inspection shall be conducted to determine correction of critical violations. If critical items remain uncorrected at this point, the permit shall be suspended and a closure order be issued. The facility shall not reopen until the critical item is corrected and the department gives written approval. Non-critical items noted on the inspection report shall be corrected within 30 days.
