Chapter 38. HEALTH AND SANITATION |
Article VI. PUBLIC HEALTH AND SAFETY NUISANCES |
§ 38-201. Definitions.
(a)
Public health or safety nuisance means any condition which might endanger the health or safety of the public, including but not limited to:
(1)
Unsanitary or improper storage or disposal of trash, garbage, refuse, debris, or other solid waste which creates an infestation and harborage of rodents, or the breeding of flies;
(2)
Rodent or insect infestation;
(3)
The accumulation of water in artificial containers causing mosquito breeding or proliferation;
(4)
Unburied dead animals;
(5)
Improper disposal of medical, dental, veterinary or pharmaceutical equipment or supplies, including but not limited to syringes, needles, scalpels, and blades or other medicinal items in solid or liquid form, in such a manner as to make it possible for any other person to retrieve and utilize said equipment or supplies;
(6)
Any other condition that may be injurious to the public's health and safety.
(b)
Director means the Director of the Knox County Health Department or the director's designee.
(c)
Infestation means the presence of rodents, insects, or other pests of such kind or in such numbers to cause a hazard to health.
(d)
Rodent for the purpose of this article, means rat or mouse.
(e)
Artificial containers means any man-made container, including, but not limited to: tires, swimming pools, boats, cans, vases, buckets, bird baths, drainage or retention basins.
(f)
Abatement for the purpose of this article, means to take measures to eliminate, correct or control the nuisance condition, thereby minimizing the potential danger to the public's health and safety.
(g)
Responsible party means the owner of the property on which the public health or safety nuisance is located, or the lessee of such property if the property is leased, where the lessee is responsible, in whole or in part, for creating or maintaining the nuisance condition.
(h)
Person means and includes any individual, partnership, firm, or corporation.
