§ 2-921. In line of duty disability benefit.

  • (a)

    An eligible county employee who suffers personal injury or sickness in the line of duty on or after January 1, 2014, shall be eligible to receive and be paid a monthly in line of duty disability benefit equal to 60 percent of pre-disability compensation after a minimum 90-day elimination period, so long as disability continues, to the earlier of social security normal retirement age, or until the employee elects to commence receiving a benefit under any county-funded retirement plan.

    (b)

    An eligible county employee who suffers personal injury or sickness in the line of duty prior to January 1, 2014, who was eligible for and was a participant in the uniformed officers pension plan at the time of the disability shall be eligible to receive and be paid a monthly in line of duty disability benefit equal to 50 percent of average compensation, so long as disability continues, for life.

    (c)

    An eligible county employee who suffers personal injury or sickness in the line of duty prior to January 1, 2014, who was eligible for and was a participant in the closed defined benefit plan or the asset accumulation plan at the time of the disability shall be eligible to receive and be paid a monthly in line of duty disability benefit equal to 50 percent (or 60 percent if there is a dependent child) of average compensation, so long as disability continues, to the earlier of normal retirement age under the closed defined benefit plan or the asset accumulation plan, as the case may be, or until the employee elects to commence receiving a benefit under any county-funded retirement plan.

    (d)

    The benefit provided in subsections (a)—(c) shall be subject to offset for Social Security disability and workers compensation benefits and adjustment for earned income while disabled.

    (e)

    The benefits provided in subsections (a)—(c) shall be funded by the county and be provided by and be paid from trusts established or existing under, and eligibility for participation and benefits and definitions, limitations and conditions on benefits shall be set out in, a disability plan, uniformed officers pension plan, or closed defined benefit plan, adopted by and as amended from time to time by the pension board, which shall administer the benefits provided herein.
