§ 22-110. Procedure on violations.

  • (a)

    Upon an officer's observation of a fourth false alarm by an owner or user of a nonoutdoor alarm system at any one scene within the county during a calendar year, or a seventh false alarm by an owner or user of an outdoor alarm system at any one scene within the county during a calendar year, the officer shall give a notice to the violator for a meeting to be held at a time and place designated by the county sheriff's department.

    (b)

    The county sheriff's department shall designate a representative to conduct the hearing under this section and allow the violator an opportunity to present evidence of factors which the violator alleges excuse the violation.

    (c)

    The hearing officer may consider mitigating factors regarding the violation of this division, including but not limited to:

    (1)

    The number of actual false alarms at the location;

    (2)

    Natural weather anomalies, acts of God, or other factors beyond the control of the owner or user of the nonoutdoor alarm system.

    (d)

    After the hearing held pursuant to this section, the department designee shall advise the officer who observed the violation as to whether in the hearing officer's opinion a citation should issue.

    (e)

    Issuance of a citation for a violation of this division shall be within the sole discretion of the officer observing the violation.
