§ 10-236. Definitions.

  • The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Abandoned pools means all swimming pools as defined in this section which are maintained or exist in such condition as to demonstrate the intent of the owner that they are to be not in use for an indefinite period of time. Any swimming pool not in use for a period of one year shall be presumed to be abandoned.

    Swimming pool means a structure of manmade materials, located either indoors or outdoors, used for bathing or swimming, or for instructional purposes in swimming, diving, or other aquatic activities by humans, together with buildings, appurtenances, and equipment used in connection therewith. Included are spa type, wading, special purpose pools, or water recreation attractions including, but not limited to, those operated at camps, child care facilities, cities, clubs, subdivisions, apartment buildings, counties, institutions, schools, motels, hotels, and mobile home parks to which admission may be gained with or without payment of a fee. For the purpose of this division, the definition of swimming pool shall not include all swimming pools in existence in the county on May 20, 1991 which had an existing fence which is three feet or greater in height. All pools constructed prior to June 1, 1991 which are located on lots one acre in size or greater and located in either an agricultural or estate zone shall be exempt from this definition.
